Event Terms, Conditions and Guest NoticeBy purchasing a ticket, accepting an invitation, attending the event, entering the property, or participating in any part of the Zwartwater Origins Experience, you agree to the following terms and conditions.These terms apply to the Zwartwater Origins Experience hosted by Zwartwater on a working farm and wine estate.1. Nature of the EventThe Zwartwater Origins Experience is a curated wine, food and farm experience. The event may include, but is not limited to:A welcome drink, wine tasting, food pairing, vineyard walk, cellar tour, tank tasting, lunch in the cellar room, informal conversation with the Zwartwater team, photography, video content, and other event-related experiences.The event takes place on a working farm and wine estate. Although the cellar will not be operational on the day of the event, it remains a functional production space.2. Legal Entity and LicenceThe event is hosted by Zwartwater.The event will take place under the applicable existing liquor licence or permission available to the venue and event.Alcohol will only be served in accordance with applicable South African liquor laws. No alcohol will be served to any person under the age of 18. Guests may be asked to provide valid identification where age is uncertain.3. Age RestrictionThis is an 18+ event.No children, babies, minors or persons under the age of 18 may attend the event, unless Zwartwater has expressly agreed otherwise in writing before the event.4. Tickets, Invitations and EntryAttendance may be through paid tickets, complimentary invitations, or a combination of both.All guests must sign in on arrival.Right of admission is reserved. Zwartwater may refuse entry or remove any guest from the event if reasonably necessary for safety, legal compliance, responsible alcohol service, guest wellbeing, property protection, or the enjoyment of other guests.5. Refunds and CancellationsIf a guest cancels their attendance within 48 hours of the event, no refund will be issued.If Zwartwater cancels the full event, guests who purchased tickets will receive a full refund.Zwartwater reserves the right to amend, postpone, replace or cancel specific parts of the programme due to weather, safety concerns, farm conditions, operational requirements, supplier issues, illness, legal restrictions, or circumstances outside its reasonable control.A change to one element of the event, such as the vineyard walk, cellar tour, timing, menu sequence, tasting order or dining location, will not automatically entitle guests to a refund.6. Farm, Vineyard and Cellar EnvironmentGuests acknowledge that the event takes place on a working farm, vineyard and wine production property.The property may include uneven ground, gravel, slopes, steps, grass, soil, wet surfaces, cellar floors, cellar equipment, tanks, barrels, hoses, drains, farm roads, natural obstacles, insects, dust, mud, temperature changes, low lighting, and other ordinary risks associated with a farm, vineyard and cellar environment.Guests must remain within the designated event areas and follow the instructions of Zwartwater, event staff, farm representatives and authorised persons.Guests may not enter restricted areas or touch cellar equipment, tanks, barrels, machinery, farm equipment, vehicles, tools, chemicals, produce, animals, electrical installations or any other property unless expressly invited to do so by an authorised person.7. Vineyard WalkThe vineyard walk is weather permitting and may be changed, shortened, delayed or cancelled at Zwartwater’s discretion.The vineyard walk is optional.Guests who are pregnant, have mobility limitations, injuries, medical concerns, disabilities, balance issues or any other reason to avoid uneven ground, slopes or outdoor walking should inform Zwartwater in advance and decide whether they wish to participate.8. Footwear and ClothingGuests are strongly advised to wear comfortable, practical shoes suitable for walking on a farm, through vineyards and inside cellar spaces.Please avoid high heels or unsuitable footwear, as parts of the event may involve uneven ground, gravel, grass, soil, slopes, steps and cellar floors.Guests are also advised to wear warm clothing, as dining will take place in the cellar room, which may be cooler than a typical indoor dining space.9. Accessibility and DisabilitiesThe event takes place on a farm and may not be fully accessible in all areas.Guests with disabilities, mobility limitations, injuries, pregnancy-related concerns, medical conditions or access needs must inform Zwartwater in advance by emailing [email protected].Zwartwater will make reasonable efforts to accommodate guests where practical, but cannot guarantee that every area of the farm, vineyard or cellar will be suitable or accessible for every guest.10. Animals on the FarmThere may be a dog on the farm.Guests should not feed, touch, approach or interact with any animal unless invited to do so by the Zwartwater team or the animal’s owner.Guests with allergies, fear of dogs, pregnancy-related concerns, mobility limitations or any other concern relating to animals should inform Zwartwater in advance.11. Alcoholic and Non-Alcoholic BeveragesAlcoholic and non-alcoholic drinks will be available during the event.The event may include welcome drinks, wine tastings, water during the event, spittoons and complimentary coffee after the meal.Guests are expected to drink responsibly.Zwartwater reserves the right to refuse service of alcohol to any guest at its discretion, including where a guest appears intoxicated, behaves unsafely, or where service would be unlawful or inappropriate.Guests are responsible for arranging their own safe transport after the event. Guests must not drink and drive.12. Wine SalesWine may be available for purchase on the day.Any wine sales on the day will be for off-consumption only. This means wine purchased may not be opened or consumed at the event or on the premises, unless expressly permitted by Zwartwater in accordance with the applicable licence and event rules.13. Pregnancy and AlcoholPregnant guests, or guests who may be pregnant, are advised not to consume alcohol.Non-alcoholic options will be available.Zwartwater does not provide medical advice. Any guest who is pregnant, breastfeeding, has a medical condition, uses medication, has dietary sensitivities, or has concerns about alcohol, food safety or ingredients should make their own informed decision and consult a medical professional where appropriate.14. Food, Allergies and Dietary RequirementsGuests were requested to provide dietary requirements, allergies and relevant food-related restrictions in advance. These details have been shared with the chef and catering team for planning purposes.Zwartwater and the chef will make reasonable efforts to accommodate dietary requirements and allergies that were disclosed in advance.However, guests acknowledge that food is prepared in a shared kitchen, farm or event environment where allergens may be present. While care will be taken, Zwartwater cannot guarantee a completely allergen-free environment or eliminate all risk of cross-contamination.The menu may contain or come into contact with common allergens and sensitive ingredients, including but not limited to fish, shellfish, nuts, peanuts, dairy, gluten, wheat, soy, sesame, eggs, sulphites, meat, seafood, spices, fermented ingredients and other allergens.Guests with severe allergies, intolerances, pregnancy-related dietary concerns, medical dietary requirements or other food sensitivities must inform Zwartwater in writing before the event and should make themselves known to the team upon arrival.If a guest did not provide dietary requirements or allergies in advance, Zwartwater may not be able to accommodate last-minute changes on the day.Guests remain responsible for deciding whether any food or drink served is suitable for them.15. Special Dietary RequestsZwartwater will make reasonable efforts to accommodate disclosed dietary requirements where possible.However, this event does not cater for certified Halaal, certified Kosher, or other specialised religious, cultural or certification-based dietary requirements.Guests with such requirements are welcome to inform Zwartwater in advance, but Zwartwater cannot guarantee that the menu, preparation environment, equipment, ingredients or service process will meet those requirements.16. Cured Fish and Sensitive Food ItemsThe menu may include cured fish.Some dishes may also include ingredients or preparation methods such as cured, smoked, fermented, raw, lightly cooked, dairy-based, nut-based, gluten-containing, seafood-based or other sensitive food items.Guests who are pregnant, immunocompromised, allergic, medically restricted, or uncomfortable with any such preparation should notify Zwartwater in advance.Where possible, an alternative may be arranged, but this cannot be guaranteed without prior written notice.17. Personal Information and POPIAZwartwater may collect and process personal information such as names, contact details, booking details, attendance details, dietary requirements, allergy information, access needs and guest preferences for the purpose of managing the event, guest communication, catering, safety, administration and related services.Dietary, allergy, pregnancy-related, disability or medical information may be sensitive personal information. Such information will only be used for event planning, catering, access and safety purposes.By providing this information, guests consent to Zwartwater using it for these purposes and sharing it with relevant service providers, such as the chef, caterers or event staff, where necessary.Zwartwater will take reasonable steps to protect guest information in accordance with the Protection of Personal Information Act, 4 of 2013, which regulates the processing and protection of personal information by public and private bodies in South Africa.18. Photography, Video and Marketing ContentPhotography and video content will be captured during the event for Zwartwater marketing, social media, website, email, press, brand, archival and promotional purposes.By attending the event, guests acknowledge that they may appear in photographs, video, audio, social media content, event recaps, website materials, advertisements or other brand communications.Zwartwater may use this content without further approval, payment or compensation, provided the use is reasonable, respectful and related to Zwartwater, the event, the farm, the wines, the brand, or associated marketing purposes.Guests who do not wish to be photographed, filmed or featured in marketing content must inform Zwartwater in writing before the event by emailing [email protected], and must also notify the team again upon arrival.Zwartwater will make reasonable efforts to accommodate such requests, but cannot guarantee that a guest will not appear incidentally in wide-angle, crowd, background or atmosphere shots.Because identifiable photos and video may constitute personal information under POPIA, guests should raise any concerns before the event so that Zwartwater can take reasonable steps to manage them.19. Guest Behaviour and Respect for PropertyGuests are expected to behave respectfully toward other guests, staff, hosts, the chef, service providers, farm workers and the property.Guests may not damage, remove, interfere with or misuse any property, wine, equipment, farm infrastructure, cellar equipment, furniture, décor, plants, produce, signs, vehicles or personal belongings.Guests may be held responsible for any loss, damage, injury or cost caused by their negligent, reckless, wilful or unlawful conduct.20. Health, Safety and Personal ResponsibilityGuests are responsible for their own personal safety, behaviour, belongings and wellbeing while attending the event.Guests must follow all safety instructions given by the Zwartwater team, event staff, chef, service staff, farm representatives or authorised persons.Guests are responsible for deciding whether they are fit and able to participate in the event, including the vineyard walk, cellar tour, tasting and dining experience.21. Loss, Theft and Personal BelongingsGuests are responsible for their own belongings, including phones, cameras, bags, clothing, wallets, jewellery and other personal items.Zwartwater will not be liable for loss, theft or damage to personal belongings, except where such loss or damage is directly caused by Zwartwater’s proven gross negligence or unlawful conduct.22. Limitation of LiabilityGuests attend the event with an understanding of the ordinary risks associated with a farm, vineyard, cellar, food and wine experience.To the extent permitted by South African law, Zwartwater, its owners, employees, representatives, hosts, contractors, suppliers, service providers and affiliates will not be liable for any loss, injury, illness, damage, death, claim, cost or expense arising from a guest’s attendance at the event, except where caused by gross negligence, wilful misconduct, unlawful conduct, or where liability cannot legally be excluded.Nothing in these terms is intended to exclude, limit or waive any consumer rights that may not lawfully be excluded under South African law.23. IndemnityGuests agree to indemnify and hold Zwartwater harmless against claims, losses, damages or expenses arising from their own negligent, reckless, wilful or unlawful conduct, including damage to property, injury to others, breach of these terms, or failure to follow reasonable safety instructions.This indemnity does not apply where liability arises from Zwartwater’s gross negligence, wilful misconduct, unlawful conduct, or any liability that cannot legally be excluded.South African indemnity clauses can be legally valid, but enforceability depends on the circumstances and the fairness of the clause, especially under the Consumer Protection Act.24. Medical Assistance and EmergenciesIn the event of illness, injury, allergic reaction, accident or emergency, Zwartwater may take reasonable steps to assist the guest, including contacting emergency services or arranging basic assistance.Any medical, ambulance, emergency or related costs remain the responsibility of the guest, unless otherwise required by law.Guests with known medical risks, severe allergies or special medical needs should inform Zwartwater in advance.25. Final AgreementBy attending the event, guests confirm that they have read, understood and accepted these terms and conditions.These terms are governed by the laws of the Republic of South Africa.
